Lawyer about transfer of two ethnic Kazakhs to China: First they must serve their sentence

Astana. December 6. KazTAG - Two ethnic Kazakhs who crossed the state border illegally - Kaster Musakanuly and Murager Alimuly - must serve their sentences first, said Lyazzat Akhatova, lawyer of the Akmola Regional lawyers association .
“Immediately after the trial they cannot be transferred. First they must serve their sentence. (...) We do not much rely on the Kazakh court and the state. If they don’t get an asylum from another country before the sentence expires, they will be expelled to China, ” Akhatova told the agency’s reporter on the telephone, commenting on the statement made by Darkhan Dilmanov, deputy chairman of the border service of the National Security Committee about transfer of two ethnic Kazakhs trespassing the border to China.
At the same time, the lawyer said that they are considering options to appeal the decisions of the Kazakh authorities in the international courts in case the court rules out to deport them.
“We know that Kazakhstan will not give political asylum, because we had a similar case, Sairagul Sauytbay and they didn’t give her either (political asylum in Kazakhstan - KazTAG),” she added.
According to Akhatova, the defense will try to obtain political asylum for Chinese Kazakhs in other countries in order to prevent them from being transferred to China, as they will face death penalty there.
In the interview with the NSC press service, Dilmanov said that two ethnic Kazakhs who crossed the state border illegally would be transferred to China "at the end of the judicial process, and criminal responsibilities".
